- New York allows possession up to 3 ounces of cannabis and 24 grams of concentrate for adults 21+.
- Only OCM-licensed businesses may sell adult-use cannabis.
- No impaired driving, vehicle consumption, interstate transport, or federal-property use.
The current adult-use baseline

Those limits describe lawful adult possession under New York law. They do not authorize sale, use in prohibited places, carrying across state lines, or possession on federal property.
Buying and sharing
Adult-use sales must come from a business licensed by OCM. Adults 21+ may share within legal possession limits without compensation, but selling, bartering, or attaching cannabis to another paid transaction can be illegal.
Where consumption may be allowed
New York generally permits adult consumption in private homes and many places where tobacco smoking is allowed, but important exceptions include vehicles, private businesses such as restaurant patios, hookah or cigar bars, federal property, and many parks and beaches. Local smoking rules still apply.
Property owners can prohibit smoking or vaping on their property. Hotels, leases, condos, employers, and event venues may impose rules even when possession is lawful.
Vehicles and driving
- Possession within state limits may be lawful for adults 21+.
- Keep products securely stored and in closed containers.
- No driver or passenger may consume cannabis in a vehicle, moving or parked.
- Open cannabis containers in a vehicle are prohibited.
- Driving impaired is illegal.
Plan the ride before opening the package
A storage box, coffee, shower, or confident feeling does not make impairment disappear.
Travel and federal law
Do not cross a state or international border with cannabis. Federal law still applies on federal land and in federally controlled settings. Airports, military facilities, national parks, and federally assisted housing can involve rules very different from a neighborhood street.
“Legal in both states” does not make the trip between them legal.
Home cultivation
New Yorkers 21 and older may cultivate up to six plants for personal use—three mature and three immature—with a household cap of twelve plants, six mature and six immature. Plants must be secured from anyone under 21. Homegrown cannabis cannot be sold.
Property, lease, nuisance, fire, electrical, zoning, and local regulations can still matter. New York prohibits using flammable materials to make concentrates at home.
Work, housing, and other policies
Legal off-duty conduct does not mean an employer must permit impairment, possession at work, or use during work time. Safety-sensitive roles and federal obligations deserve specific advice.
Landlords generally cannot reject someone merely because they consume cannabis, but property owners may prohibit smoking, vaping, or growing on the premises in many circumstances. Public and federally assisted housing raises additional federal-law issues.
